What to Tell Your Sexual Assault Defense Lawyer
Your attorney will ask you several questions during your first meeting – but he or she needs answers in order to create the best possible defense for you. It’s important that you answer all your lawyer’s questions honestly and completely; remember, an attorney needs to plan appropriately to defend you in court, which means the things you discuss now will inform your lawyer’s strategy.
Your lawyer will most likely ask you about:
- What led up to the alleged incident. Where were you, who was with you, and what were you doing at the time you’re accused of sexually assaulting someone?
- Whether you have witnesses on your side. If people were with you, can they support your side of the story? What did the people with you see or hear?
- What kind of evidence the prosecutor has against you. Because your lawyer doesn’t have to convince a judge and jury that you’re innocent (instead, the prosecutor’s job is to convince the judge and jury that you’re guilty beyond a reasonable doubt), knowing what evidence the prosecutor has can help your lawyer plan your defense. In some cases, attorneys are able to convince judges and jurors that the evidence the prosecution presents doesn’t prove that you’re guilty of a crime, or that it shouldn’t be used as evidence at all.
Your lawyer will ask you specific questions as you share your story, too. It’s incredibly important that you answer your attorney’s questions honestly so he or she can put together the best possible defense.
