As a Wisconsin criminal defense attorney, it is always concerning when encountering a prosecution in conflict with perceived rights or legal exceptions. Our country holds the right of religious freedom as sacrosanct. Commensurate with that right and freedom has been an exception to child abuse laws and protections for families who adhere to strict religious beliefs faith in prayer over medical treatment. A recent conviction obtained against two parents for reckless homicide in Wisconsin after their daughter died of a treatable medical condition has been upheld by the Wisconsin Supreme Court which, according to Attorney Carlos Gamino, has basically eviscerated the faith healing exception. The Court ruled that someone can be criminally charged in Wisconsin and that the statute providing the faith healing exception will not provide protection from prosecution.
